The prices in the shop are including VAT (MwSt). For orders from EC outside Germany VAT will not be invoiced, if you give us your valid VAT Nr. together with the order. Please make sure, that adress and name registered with this nr. at your tax office are exactly the same as those in the invoice adress of the order. Especially the corporate structure of your company is important. If the adresses do not accord to each other, we cannot accept the VAT nr. Orders from outside EC always will be reduced to the VAT. The adjustement of the invoice will be done if the order is registered manually in our office. This can take a few hours. However, PAYPAL or credit cards will only be charged with the correct invoice amount. 1. General Terms & Conditions The following General Terms and Conditions apply to all contracts, deliveries and other services. Deviating terms and conditions provided by the contractual partner are expressly rejected. Any subsidiary agreements require written confirmation from us. www.kerzenkiste.de reserves the right to make any additions or amendments to these General Terms and Conditions, including all supplementary documentation, with a reasonable notification period. Orders received prior to such changes will be processed in accordance with the terms and conditions which were valid at the time the order was received. 5. Right of Cancellation We guarantee you a cancellation period of 2 weeks. You do not need to give a reason for your cancellation, which must be made in writing or by returning the goods to www.kerzenkiste.de . This notification or return delivery must be postmarked within 2 weeks of the date of delivery. If a customer cancels an order, he or she is responsible for returning the goods to us, if they can be mailed to us as a parcel. If this is impossible, the customer is responsible for requesting that www.kerzenkiste.de collect the goods. The customer is responsible for the return shipping costs, unless the goods supplied do not correspond to the goods ordered. Exceptions to the right of cancellation are goods which are made to order or procured for a particular customer, and which are not part of our regular inventory. The customer is responsible for compensation for any loss of value caused by using the goods in the manner for which they were designed. Goods must be returned to us in the original packaging. The customer is liable for any damage caused by returning the goods to us with insufficient packaging.. 3. Delivery and Payment www.kerzenkiste.de's delivery and payment conditions are detailed in our Shop. There are no minimum order quantities. 4. Delivery Dates Orders are always shipped on Mondays Wednesdays. If we receive your order by early Monday or Wednesday morning, the goods will be sent same day. We deliver by DHL parcel service. If you want express service, please select "Pick up by client" as shipping mode and arrange shipping with your parcel service and our shipping departement email@candlecraftcenter.com 6. Transfer of Risk Goods are insured by www.kerzenkiste.de during shipping. For goods fetched by the client or his carrier, insurance has to be paid by the client. 7. Guarantee www.kerzenkiste.de guarantees that the goods sold are free from material and manufacturing defects at the time of the transfer of risk, and that they conform to the description given in the contractual agreement. When the goods arrive, the customer is responsible for inspecting the goods for quality and potential defects. Any obvious or hidden defects must be reported to us in writing within 10 days after discovery in order for them to be covered by the guarantee. The guarantee expires 24 months from the date of shipping. Any claim must be accompanied by an invoice as proof of the purchase date. The guarantee does not extend to normal wear and tear. The guarantee is void if the customer modifies the goods supplied. Under the terms of the guarantee, www.kerzenkiste.de reserves the right to repair the goods free of charge. Articles may be partly or completely exchanged. If defects are not remedied within a reasonable period of time, the customer has the right to a refund or to a reduction in the purchase price. § 476a of the German Civil Code applies. 8. Retention of Title Until the order has been paid in full, the goods remain the property of www.kerzenkiste.de 9. Data Retention According to § 28 of the Bundesdatenschutzgesetzes [German Data Protection Act, or BDSG] we would like to state that the data we collect for the purposes of performing business transactions is processed and stored in accordance with § 33 of the BDSG. Personal details are, of, course, handled confidentially. 10. Place of Performance, Place of Jurisdiction and Applicable Law If the contractual partner is a private consumer, legal regulations shall continue to apply. The laws of the Federal Republic of Germany apply. If the purchaser has no general place of jurisdiction in the Federal Republic of Germany, or moves his domicile or usual residence outside the area of jurisdiction of the Federal Republic of Germany once the contract has been concluded, our place of business is deemed to be the place of jurisdiction. This also applies if the domicile or usual residence of the purchaser is unknown at the time the claim is raised. For contracts with traders, legal persons under public law and special funds under public law, Karlsruhe is agreed to be the place of performance for delivery and payment as well as the place of jurisdiction, with the proviso that we are also authorised to raise claims in the town/city where the customer has his/her headquarters or a branch. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. German law applies. If one or more of the provisions of these Terms and Conditions becomes invalid, this does not affect the validity of the remaining provisions. The invalid provision is replaced in accordance with applicable law. |
